2. Services

Milam Equipment Rentals provides heavy equipment rentals, repair services, and related services in North Carolina. Equipment availability, pricing, and rental terms are subject to change without notice. All rental agreements are governed by the specific rental contract signed at the time of rental, which may contain additional terms that supplement these general Terms and Conditions.

3. Rental Terms

• Eligibility: You must be at least 18 years of age and possess a valid form of identification to rent equipment. Commercial renters may be required to complete a credit application.
• Equipment Use: All rented equipment must be used in accordance with manufacturer guidelines and applicable safety regulations. Misuse, abuse, or unauthorized modification of equipment is strictly prohibited.
• Responsibility: The renter is responsible for the equipment from the time of delivery or pickup until it is returned to Milam Equipment Rentals. This includes responsibility for loss, theft, or damage beyond normal wear and tear.
• Return Condition: Equipment must be returned in the same condition as received, less normal wear and tear. Equipment returned excessively dirty, damaged, or with missing components will be subject to additional charges.
• Late Returns: Equipment not returned by the agreed-upon date and time will incur additional rental charges at the applicable daily rate until returned.

4. Pricing and Payment

All prices are quoted in U.S. dollars and are subject to change without notice. Rental rates do not include applicable taxes, delivery fees, fuel charges, or environmental fees unless expressly stated. Payment is due in accordance with the terms of your rental agreement or credit account. Past-due balances may be subject to late fees and interest charges as permitted by law.

5. Delivery and Pickup

Delivery and pickup services are available for an additional fee. Delivery times are estimates and not guaranteed. The customer is responsible for ensuring adequate site access for delivery and pickup of equipment. Milam Equipment Rentals is not liable for delays caused by weather, road conditions, or other circumstances beyond our control.

6. Limitation of Liability

To the fullest extent permitted by law, Milam Equipment Rentals, LLC, its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our equipment, services, or website. Our total liability for any claim shall not exceed the amount paid by you for the specific rental or service giving rise to the claim.

7. Indemnification

You agree to indemnify, defend, and hold harmless Milam Equipment Rentals, LLC, its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to your use of rented equipment, violation of these terms, or any negligent or wrongful act or omission on your part.

8. Insurance

Renters are strongly encouraged to maintain adequate insurance coverage for rented equipment. Unless otherwise agreed in writing, the renter assumes all risk of loss or damage to the equipment during the rental period. Proof of insurance may be required prior to equipment release.

The content on this website is provided for general informational purposes only. While we strive to keep information accurate and up to date, we make no warranties or representations about the completeness, accuracy, or reliability of any information on this site. Equipment images shown may not represent exact models available for rent.

10. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Milam Equipment Rentals, LLC or its content suppliers and is protected by United States copyright and trademark laws. Unauthorized use, reproduction, or distribution of any content is strictly prohibited.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Brunswick County, North Carolina.

12. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
